Single Parents on Holiday Ltd. (“the Insured”) holds a Professional Liability Policy with Arnold Fisher Insurance Services Limited underwritten by the Royal Sun Alliance.
Our policy includes Public/Products Liability and Professional Indemnity providing indemnity to any Person Entitled to Indemnity up to the Limit of Indemnity against legal liability for damages in respect of:
- accidental injury to a person;
- accidental loss of or damage to Property;
- nuisance trespass to land or trespass to goods or interference with any easement right or air light water or way other than legal liability for damage which result from a deliberate act […]*;
- breach of professional duty by reason of any neglect error or omission occurring or committed in good faith by the Insured, any Employee or any Agent.
Our policy further includes Emergency Assistance providing indemnity to the Insured to the Limit of Indemnity in respect of Regulation 15 (7) of the Package Travel, Package Holiday and Package Tours Regulations 1992 or Clause 2.8 (iii) of the ABTA Code of Conduct for:
- general assistance provided to passengers
- legal costs incurred by passengers with the prior agreement of the Insurance
in connection with illness, injury or death through misadventure […]*.
Our policy further includes Legal Defence Costs providing indemnity to the Insured and, if the Insured so requests, any Employee or director or partner of the Insured up to the Limit of Indemnity in respect of:
- legal costs and other expenses incurred with the Insurer’s written consent and costs awarded against the Insured or any director, partner or Person Employed in connection with criminal proceedings brought or in appeal against […]* in respect of a breach of:
- The Health and Safety at Work etc Act 1974 […]* where the proceedings relate to the health, safety and welfare of any Person Employed, director or partner of the Insured;
- The Health and Safety at Work etc Act 1974 […]* where the proceedings relate to the health, safety and welfare of any person other than a Person Employed, director or partner of the Insured;
- Part II of the Consumer Act 1987;
- The trade description Act 1968;
- The Package Travel Holidays and Package Tours Regulations 1992 issued under Section 2 (2) of the European Communities Act 1972 and or any equivalent legislation within the European Union as may apply […]*.
